Account Registration and Security

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized access or security breach
• One person or entity may not maintain more than one free account
• You are fully responsible for all activities under your account

Prohibited Uses

You agree not to use the Service to:

• Upload, post, or transmit any unlawful, harmful, threatening, abusive, or offensive content
• Violate any intellectual property rights of TheJobChaser or third parties
• Impersonate any person or entity or falsely represent your affiliation
• Engage in any automated use of the system without express written permission
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to decipher, decompile, reverse engineer, or hack the Service
• Collect user information for commercial purposes
• Use the Service for any illegal activities or to violate any laws

Content Standards

• All content must be accurate, truthful, and not misleading
• Content must not infringe on intellectual property rights
• Content must comply with all applicable laws and regulations
• We reserve the right to remove content that violates these standards

Subscription Plans

• Free Tier: Limited usage with 10 resumes, applications, and cover letters
• Premium Tier: Enhanced limits and additional features
• High Volume Tier: Custom limits for enterprise users

Payment Processing

• All payments are processed securely through Stripe, Inc.
• We do not store your payment card information
• Subscription fees are billed in advance on a recurring basis
• All fees are in USD unless otherwise specified
• You authorize us to charge your payment method for all applicable fees

Billing and Renewals

• Subscriptions automatically renew unless cancelled before the renewal date
• We will charge your payment method on the renewal date
• Price changes require 30 days advance written notice
• Failed payments may result in service suspension
• You remain responsible for any unpaid fees

Refunds and Cancellations

• New subscribers may request a full refund within 14 days of initial purchase
• Refunds beyond 14 days are at our sole discretion
• No refunds for partial billing periods or unused services
• Cancellations take effect at the end of the current billing cycle
• You may cancel anytime through your account settings

Taxes

You are responsible for any applicable taxes, duties, or government assessments related to your use of the Service.

Our Intellectual Property

• TheJobChaser owns all rights, title, and interest in the Service, including software, designs, content, trademarks, and proprietary methods
• Our intellectual property is protected by copyright, trademark, patent, and other laws
• No rights are granted to you other than the limited license described herein
• You may not use our trademarks or service marks without prior written consent

Your Content and Data

• You retain ownership of all content and data you submit to the Service
• You grant us a limited license to use your content solely to provide the Service
• You represent that you have all necessary rights to the content you submit
• You may export or delete your data at any time
• We do not claim ownership of your personal information or job search data

Copyright Infringement

We respect intellectual property rights and expect users to do the same. If you believe content on our Service infringes your copyright, please contact us at contact@thejobchaser.com with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material
• Your contact information
• A statement of good faith belief that use is not authorized
• A statement that the information is accurate and you are authorized to act

Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OF DATA TRANSMISSION
• RESULTS FROM USE OF THE SERVICE

No Employment Guarantees

We do not guarantee that use of our Service will result in job interviews, employment offers, or career advancement. Job search success depends on many factors outside our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

WE SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
• DATA LOSS OR CORRUPTION
• COST OF SUBSTITUTE SERVICES
• LOSS OF EMPLOYMENT OPPORTUNITIES
• DAMAGES ARISING FROM THIRD-PARTY CONDUCT

Indemnification

You agree to indemnify, defend, and hold harmless TheJobChaser and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

Termination by You

• You may terminate your account at any time through account settings
• Termination stops future billing but does not entitle you to refunds
• You have 30 days after termination to export your data
• We may permanently delete your data after the 30-day period

Termination by Us

We may suspend or terminate your account immediately if you:

• Breach any provision of these Terms
• Engage in fraudulent, illegal, or harmful activities
• Fail to pay required fees
• Violate our intellectual property rights
• Use the Service in a manner that could damage our reputation or systems

Effect of Termination

• All rights granted to you under these Terms immediately cease
• You must stop using the Service
• Outstanding payment obligations survive termination
• Provisions intended to survive termination will continue to apply

Governing Law

• These Terms are governed by the laws of the Province of Ontario, Canada
• Ontario provincial and federal courts have exclusive jurisdiction
• You consent to personal jurisdiction in Ontario
• The United Nations Convention on Contracts for the International Sale of Goods does not apply

Mandatory Arbitration

Except as specified below, any dispute arising from these Terms or the Service must be resolved through binding arbitration:

• Arbitration will be conducted by the American Arbitration Association (AAA)
• AAA's Commercial Arbitration Rules will apply
• Arbitration will take place in Ontario or remotely
• The arbitrator's decision is final and binding
• You waive the right to a jury trial and class action participation

Exceptions to Arbitration

• Small claims court disputes under $10,000
• Intellectual property disputes
• Emergency injunctive relief
• Claims that cannot be arbitrated under applicable law

Class Action Waiver

You agree that disputes must be resolved on an individual basis and waive any right to participate in class actions, collective actions, or representative proceedings.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheJobChaser and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, epidemics, government actions, or network failures.

Survival

Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law.
